They cannot just go into someone's bank account. They must be granted permission by a court to garnish a bank account, and the court will only grant such permission if they file a lawsuit with the court. Doing so means you 'have your day in court', meaning you have the opportunity to go to court to address the issue.Failure to show up means they automatically win and get a judgment against you, which the court will enforce by allowing the garnishment. So if they haven't served you with court papers, you're safe for now.
It takes a court order to draft funds from someone's account. That is unless the debt is owed to the IRS and then they just take the funds anyway. A debt collector would have to go tgo court and get an order from the judge to allow them to take funds from a private bank account. It is uncommon for them to go to this length but not totally unheard of either.
If I have no money at the moment but WILL pay them back asap! Can they get into my bank account and savings and take my money?
In the first sentence you say you have no money.
The second sentence you say you have savings.
Contradict yourself you did...
They see only "you have money" They can freeze your account so you can't get into it. "Go ahead, make their day." They have scary legal abilities. And yes, they can TAKE it from you.
That money in your account is "NOT YOURS" It belongs to whomever you owe money to.
Right?
If you ever gave them bank information in order to make a payment - then yes -and yes they will. Otherwise no.
