I cant afford my gym membership anymore?

Posted at: 2015-05-24
I was going to an MMA gym for a few months in Boca Raton. I lived there for a little while and I had a good paying job. I ended up leaving boca unexpectedly and I stopped working. I didnt get a chance to cancel the membership and I owe them $380 which I dont have.. If I cancel, I owe them $380 more. I signed a contract and I honestly cant afford it.. what do I do? I dont want to walk in and cancel without having money that I owe

If the early cancellation fee is $380, then figure out if that is more or less than what is owed under the remainder of the contract. That should help you decide on whether or not you should cancel it. You have to pay it off. You signed a contract. In most states, if they have to sue you to get their money, they will be entitled to treble damages because it is awarded in breach of contract cases. That means you will owe three times the face value. So, for example, if you owe $500, they will be awarded $1,500... plus attorney 's fees, costs and interest around 10 percent. Get a job and pay it off as soon as you can. Talk to them and work out monthly installments. Otherwise, some day, you might find your bank account zapped or the embarrassment of garnisheed wages. Next time, do not sign a contract that you are not absolutely sure that you can comply with.

Offer to pay them $32 a month for the next year, to pay off the original $380. If they don't for go for it, send them a certified letter, return receipt, that you're canceling the membership. If you're no longer in FL - and they don't have your SSN, what can they do to you?

You can't just ignore it, so cancel it. Plead with them for some leniency, but you continue to owe them money until you break the contract, and that usually comes with some penalty. That's reality for you. If you don't break the contract, they'll just dump it all on a collection agency, and you'll be ****** for years.

Try talking to them and plead for mercy - really. You lost your job and moved away. They may not turn it to collection since they may have to pay them to start collection. Explain to the gym that you would rather negotiate with them or you'll do it with the collection agency.

You read the contract, find out what it takes for an early termination and then carry out your obligation.
