Definetly the home owners- but there must be an implied warranty on new construction- call the town hall./inspector that the house was built and ask-

Also really important to READ all of the small print on any materials, contracts this seller gave to the buyers.

Additionally, research whether or not this is a common problem to known with this builder- it could be class action law suit material. The other thought is the house had to have had a town and private inspection in order to get a mortgage- go back to those people/inspectors and start asking a lot of questions- the insurance company may do that as well.

They should seek professional help with the clean up- companies like Service Pro have huge fans and dehumidifiers that take 99% of the moisture out of the house- HUGE in terms of preventing MOLD.

I would also suggest that they have a licensed plumber- LARGE company come over and check the rest of the plumbing- one of the biggie and common mistakes contractors make on new construction is putting a nail through a plumbing pipe or several of them. When this happens and it does more often than not- the entire wall has to be opened and the entire pipe replaced.

The cost of the Service Pro company would be an expense covered by the home owners- but the home owners will also have to manage/cover their deductible. Having professionals do the clean up- is another way of deferring the liability to another company in the event of mold developing- as they are professionals that should know how to manage water/flood issues.

Oh wow, I would suggest calling a professional - First I would get a GOOD home inspector - Then I would get insurance claim, THEN I would do all the things that need to be done. Good Luck! But getting a home inspector will be the best thing!

Not all insurance will cover water leaks because of possible mold concerns. It may take a lawyer or a trip to small claims court.
